1. Introduction
These Terms of Service (“Terms”) form a legal agreement between you and HomePassport (“HomePassport”, “we”, “us”, or “our”) and govern your use of our website, web and mobile applications, and related services (together, the “Services”).
By creating an account, subscribing, or otherwise using the Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Services. These Terms should be read together with our Privacy Policy and Cookie Policy.
2. Definitions
- “Account” means the account you register to access the Services.
- “Content” means any documents, records, images, notes, messages, and other material you upload, store, or share through the Services.
- “Subscription” means a paid plan giving access to certain features for a recurring fee.
- “Business Customer” means an organisation (such as a landlord or letting agency) that uses HomePassport to manage properties and may invite other users.
3. Eligibility & accounts
You must be at least 18 years old and able to enter into a binding contract to use the Services. When you create an Account, you agree to:
- Provide accurate, current, and complete information.
- Keep your login details confidential and not share them with others.
- Be responsible for all activity that takes place under your Account.
- Notify us promptly if you suspect any unauthorised use of your Account.
If you use the Services on behalf of a Business Customer, you confirm you are authorised to bind that organisation to these Terms.
4. Subscriptions & billing
Some features require a paid Subscription. Pricing is shown on our website and may be charged per property, per month or per year, depending on the plan you choose.
- Payments are processed securely by our third-party payment provider. We do not store your full card details.
- Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. By subscribing, you authorise us to charge the applicable fees on each renewal.
- Fees are billed in advance and, except where required by law, are non-refundable for partial periods.
- We may change our prices from time to time. We will give you reasonable notice of any price change, which will take effect at your next renewal.
- If a payment fails, we may suspend or downgrade your access until payment is resolved.
As a consumer, you may have a statutory right to cancel within a cooling-off period. Where you ask us to begin providing the Services during that period, you acknowledge you may lose that right once the Services have been fully provided.
5. Free trials
We may offer a free trial. Unless stated otherwise, at the end of the trial your Subscription will begin and the applicable fee will be charged, unless you cancel before the trial ends. We may change or withdraw trial offers at any time.
6. Your content & responsibilities
You retain ownership of your Content. You grant us a limited licence to host, store, process, and display your Content solely to provide and improve the Services and as permitted by our Privacy Policy.
You are responsible for your Content, and you confirm that:
- You have the right to upload and share it, including any personal data of third parties it contains.
- It does not infringe anyone’s rights or break any law.
- You keep your own copies where important — the Services are not a substitute for your own backups.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or harmful purpose.
- Upload malware or attempt to gain unauthorised access to the Services or other users’ data.
- Interfere with or disrupt the integrity or performance of the Services.
- Copy, resell, or reverse-engineer the Services except to the extent permitted by law.
- Upload content that is unlawful, defamatory, or infringes intellectual property or privacy rights.
9. Intellectual property
The Services, including all software, design, text, and branding (excluding your Content), are owned by HomePassport or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms. You may not use our name or logos without our prior written permission.
10. Availability & changes
We work hard to keep the Services available but do not guarantee they will be uninterrupted or error-free. We may carry out maintenance, update features, or modify or discontinue parts of the Services. Where a change materially reduces the Services, we will give you reasonable notice where practicable.
11. Cancellation & deletion
You can cancel your Subscription at any time from your account settings; cancellation takes effect at the end of your current billing period. You can request deletion of your account, which follows the process described in our Privacy Policy, including any grace period before permanent deletion. On deletion, your Content may be permanently removed and cannot be recovered.
12. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all implied warranties. HomePassport is a tool to help you organise property information; it does not provide legal, financial, or compliance advice, and you remain responsible for meeting your own legal and regulatory obligations.
13. Limitation of liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.
Subject to the above, and to the fullest extent permitted by law:
- We are not liable for loss of profits, loss of business, loss of goodwill, or any indirect or consequential loss.
- We are not liable for loss or corruption of data to the extent it results from your failure to keep your own backups.
- Our total liability to you for all claims arising out of or relating to the Services in any 12-month period is limited to the amount you paid us for the Services in that period.
If you are a consumer, these Terms do not affect your statutory rights.
14. Indemnity
If you use the Services as a business, you agree to indemnify us against any claims, losses, or costs arising from your breach of these Terms, your Content, or your unlawful use of the Services.
15. Suspension & termination
We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or to protect the Services or other users. You may stop using the Services at any time. On termination, your right to use the Services ends, though provisions that by their nature should survive (such as liability and governing law) will continue to apply.
16. Governing law
These Terms and any dispute arising out of them are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
17. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Services after the changes take effect means you accept the updated Terms.
